5. >> i'm ken wayne. >> i'm heather holmes. we begin in boston where federal officials are moving forward in the legal proceedings of the marathon bombings. the only suspect, dzhokhar tsarnaev has yet to be charged according to the justice department. there are criticisms arising about how the fbi may have dropped the ball. >> reporter: the surviving suspect in the boston marathon bombings could be charged at his hospital bed side on sunday. dzhokhar tsarnaev is still in serious condition. he is sedated with a tube down his throat and unable to speak. although massachusetts does not have the death penalty, prosecutors could seek capital punishment at the federal level. >> given the facts that i've seen, it would be appropriate to use the death penalty in this case. i hope they would apply it in federal court. >> reporter: more questions are being raised about the suspect

and if the fbi did enough before the bombings. in 2011, it interviewed the older brother, tamerlan tsarnaev, after russian authorities alerted the u.s. government. he made a trip to russian in 2012. >> the ball was dropped in two ways. the fbi missed things or our laws do not allow the fbi to follow up in a sound solid way. >> reporter: while officials cyst through the details worshipers sought answers in their own way gathering at the holy cross on sunday to reflect on the terror that the city faced in the last week. the governor says there can be vigilance without fear. >> there are lessons that we will have to learn and have learned painfully through this last experience that will have to be applied to future marathons. there will be future marathons.

and they will be bigger and better. >> reporter: according to a person, they are still looking at the cause of death of tamerlan tsarnaev. >> the three people killed in the explosions as well as a fallen mit police officer sun collier were rememberedberg a prayer service today. as you can see, flowers were left near the finish line. the mayor has asked americans to observe a moment of silence at 2:50 in the afternoon. that is the time that the first of the two bombs went off. >> as the focus of the boston bombings turns to the legal aspect, one california senator is voicing her opinion for the 19-year-old suspect to be treated as an enemy combatant. that means he would be questioned by interrogators without any due process. >> it is clear to me that the course that can be taken, you have the high value interrogation group. >> the other legal option is to

treat him as a criminal defendant. that means he must be read his miranda rights, notifying him of his right to remain silent. ed davis says the two bombing suspects were planning more attacks. >> we have reason to believe based upon the evidence that was found at that scene, the explosions, the explosive ordinance that was unexploded and the fire power that they had that they were going to attack other individuals. >> so far, police have not released any information about a possible motive. this is the first sunday since the boston marathon bombings and thousands around the bay area gathered at church services today to pray for the victims. we will have that part of the story in about 30 minutes. you can find more on our website. there is a special tab on the front page with pictures and a slide show. log on to ktvu.com for our continuing coverage online. >> in san jose, police are looking for clues in two

separate shootings, one involving a car filled with people. it happened outside of the fiesta nightclub and restaurant. an argument inside may have spilled out into the parking lot. investigators say the gunman drove up, fired several rounds into a car with five people inside. no one was wounded. another shooting happened near stow avenue in san jose. police haven't released any information. the wounded man was taken to a hospital. his condition hasn't been released. >> one of the nation's best known new faces in the fight for a stricter gun control was in the bay area today vowing to hold members of congress accountable. cara is live in san francisco. >> reporter: he was a key note speaker. after speaking to the american

association of community colleges about education, space shuttle endeavour's final mission and his wife gabby gifford's, he talked to us about gun control. >> they failed to do what we were asking them to do, pass an expanded background check bill. >> reporter: families of the connecticut shooting voiced strong opinions today. >> i was disgusted that there are so many senators doing nothing about the fact that my mom was gunned down in her elementary school along with five other educators and 26 seven-year-old children. it's grossly unfair. >> my sister pushed the kids up against the wall of her entire class. my sister grabbed her keys to

lock the door and that's when he came in the room. my sister was not a coward. she protected her kids. why aren't they protecting us. >> reporter: senators that voted down the legislation expressed concern about second amendment rights and burdening folks buying and selling guns. >> we are raising millions and millions of dollars and we will try to educate the public not only how the member of congress voted but how they feel about this issue. we're not going away. >> reporter: that sentiment echoed by bay area members that demand action. they plan to thank the legislatures that voted for the amendment and put pressure on those that did not. >> alameda county sheriff deputies are investigating the death of a woman. the woman in her 50s was discovered in a pool of blood in her driveway in the 1600 block of silver leaf drive this morning.

investigators are trying to determine if the death was an accident or homicide. >> an attempted robbery in oakland's rock ridge neighborhood ended with gunfire. as ktvu tells us, the victim of the holdup was wounded and now neighbors are worried. >> reporter: the man and woman were walking home around 9:30 last night when they were held up at gun point. for some reason, police say the man opened fire. he was transported to the hospital but expected to survive. neighbors are surprised by the violence in a neighborhood that they consider safe. >> you have to be careful walking to work early. it happens every once in a while around here. >> reporter: in rock ridge, a lot of people walk, enjoying the shops and restaurants. we caught up with norm out for his morning run. he hopes this shooting won't keep the neighbors home. >> people go out to the restaurants and they enjoy the restaurants and this might

cause some difficulties as far as the restaurants being populated in the evening time. >> reporter: this is the kind of area that neighbors truly do look out for one another. the head of one public safety group tells me that last night's holdup should be a reminder that rock ridge is not immune to crime. castro tells me that he can't remember a shooting in this area in the last ten years and he hopes neighbors learn from what happened. >> be aware of your surroundings, don't be on a cell phone, be aware of your surroundings. crime can happen anywhere here in oakland, even in a beautiful neighborhood like rock ridge. it's a target rich environment. >> reporter: in this case, the shooter took off without stealing anything, leaving one man hospitalized and the neighborhood rattled. >> the coast guard boat

returned to the home port in alameda today after a month- long mission. she performed two rescues along the way, the first involving two people about 90 miles off of san diego in a sinking boat. the other was just two days ago when there was a cap sized boat off of san diego county. they seized more than 2400 pounds of marijuana. there's no word on when she will shove on her next deployment. >> a really nice day across the entire bay area. lots of sunshine as temperatures are back up into the 70s and 80s. even san francisco maxed out in the 70s this afternoon. right now on live storm tracker 2, you can pick out the radar and satellite loop. you will notice the clouds heading up to the north. but the bay area is in the clear right now. we are expecting clear skies for the overnight hours. as far as current temperatures updated for this 5:00 hour, the numbers have been coming down a

little bit over the past hour or so. still, some 80s to report out towards santa rosa, fairfield, concord, 86 degrees. san jose, 82. san francisco, a little bit of a sea breeze kicking in. it's 64 degrees. overnight lows, tomorrow morning, not too cold. most locations starting out in the 50s. san francisco 50 degrees. and san jose, 55. here is the forecast model showing a lot of 50s across the region at 6:00 as we showed you. into the afternoon hours, another nice warmup. in fact you see the range from the upper 60s, lots of 70s. and the warmest locations inland could hit the 90-degree mark. we will take a look at the specific temperature in your neighborhood and let you no he when the cooling kicks in on the five-day forecast. >> before a committee would establish basic standards for short-term day care centers at

>> tonight, southern california firefighters are close to containing a brush fire in the san gabriel mountains. it broke out yesterday in a backyard. initial reports blame a gardener for sparking the flames with a weed trimmer. no one has hurt. a evacuation for 200 homes was lifted today. >> spring flooding has killed at least three people. communities along the mississippi river had a rough night with crests reaching 10 to 12 feet above flood states.

vehicles were swept aside, with people inside. barges sank near st. louis. residents continue to sand bag as they hear a forecast for more heavy rain tomorrow night. >> in georgia, they're digging out from a tornado. it destroyed half dozen homes and countless trees. neighbors are helping others deal with all of the damage. >> the communities have come out and helped everybody. it's been an outpouring of love. >> one woman was injured when the tornado wrecked her mobile home, throwing her to the ground. no other serious injuries were reported. >> colorado authorities have recovered five bodies in a deadly avalanche. they were snowboarding yesterday when an enormous amount of snow gave way. a sixth snowboarder managed to dig himself out. he was fortunate that he could save himself. >> if he hadn't gotten himself

out and been able to call for help, who knows how long it would have taken. >> the avalanche caved in a section of snow 650 feet wide, a thousand feet long and 8 feet deep. avalanche dangers are high in the rockies this spring due to a lack of snow. >> the department of health and human and centers for disease control allow dollars to be used for law making efforts. now, the group says that the county used $345,000 in federal grant money to lobby legislators to support a tobacco tax increase. the county stated that this was its intent in its federal

application. a new analysis of state government workers shows that 75 retired executives are working for the state. this despite the governor's order to remove all but the most critical retireys from the workforce. the retireys are earning between $45 to $75 an hour even as they're drawing their pensions. >> all three major bay area airports today say flights are running smoothly, the first day of the furloughs. there are what they call random delays on the east coast, but there was no way of telling if they were relate today staffing cut backs. air traffic controllers are set to be furloughed one day every other week. a legal challenge to the furloughs brought by pilots and an airline group is working its way through the courts. it will be time to close the curtains for good after

tonight's movie showings at an east bay movie house. >> reporter: ken, we're live in front of the theater tonight. we have been here for a few hours. those wanting to save the dome have collected signatures for a petition. they have t-shirts. they're not giving up on keeping it open. the planning commission has approved a project that would demolish the dome theater. in its place, a dick's sporting goods would be built. now, in a few weeks, the entire matter goes before the city council on may 6th. the movie theater will close avenue tonight's last show. there is a small grass roots group which has garnered about 500 signatures from residents and movie goers who want the dome open. the theater is almost as old as the city itself and it could be renovated to be a new kind of

meeting place for old and young alike. >> we are trying to inform movie goers about what is happening. a lot of people haven't had any public outrage about what is happening. so we're going to go into local areas like the mall and we're going to get foot traffic going. >> reporter: management told us that they can't speak to us on camera about the dispute. the parent company does not own the building so they have no say in whether they stay or go. the last movie tonight, 2011 space odyssey begins at 7:00. we will be talking to movie goers. we already tried contacting city council members about the closing. i have to pan over a bit. these are the supporters. they are chanting save the dome. we will have their story for you tonight at 10:00. reporting live in pleasant hill, jade hernandez, ktvu channel 2 news. >> tonight, we are learning that actress reese witherspoon was briefly jailed in atlanta

on friday. the actress was arrested after her husband was pulled over and arrested on suspicion of driving while intoxicated. witherspoon was arrested for disorderly conduct after disobeying orders to stay inside the vehicle. the host of nbc sunday night football has been arrested on suspicion of drunk driving. al michaels was arrested on friday night. he spent more than five hours in jail before being released. michaels was charged with misdemeanor dui and back in court on june 26th. neither michaels or nbc has commented on the charges. >> the death toll climbs after a massive earthquake in china. we will tell you what rescue crews are doing to reach isolated villages. >> there was some apprehension after the boston bombings, but that didn't stop tens of thousands of people from running and watching the london marathon.

after being attacked by a shark. it happened about 170 miles north of sidney. the man was pulling nets in shallow water when a shark bit him in the leg. he is expected to recover. demonstrations were held in jerusalem. they are upset about the cabinet level approval that will lower ticket prices and expand the number of flights to and from europe. the government says it will help the economy by increasing tourism. >> the first major international marathon since the double bomb attack in boston was held today in london. the boston bomb victims were remembered as a huge crowd cheered on all of the runners. across the pond, runners kept their stride. >> we're going to reclaim our lives. we're not going to let a couple guys take it away from us.

>> reporter: the bombings at boston mar heavily influenced the london marathon for runners and organizers. they observed a moment of silence, remembering fellow runners brought down during what should have been a day of personal accomplishment. >> how can you not run for the people of boston and think about that. so motivational and inspirational. >> reporter: huge crowds lined the 26.2 mile race, while organizers brought in hundreds of additional officers to provide security. it's been fine. >> reporter: for every runner to cross the finish line, organizers are donating two british pounds to onefundboston. it is expected to come to

meanwhile boston officials are getting ready to reopen the area that has been closed since the bombing. >> there is a lot of logistical issues attached. >> the barricades and grand stands from the race still need to be removed and city officials say memorials to the victims will be temporarily relocated to copley state park when the city decides where to put a more permanent memorial. >> many people attended church services since the bombings. some church goers say they have been praying more than usual this week. they are able to cope with the hoar identifying events through their faith. >> this week, you know, you're in prayer because every time that you turn on the news, it's about killing and you have to constantly stay in prayer. and the bible teaches us to pray. >> it raises awareness about the violence nationally and in the community. >> the north bay plans to run

to honor the victims of boston. it is in marin county. participants are encouraged to wear blue and yellow clothing. runners can share stories to describe the emotional toll of the last week's events. >> plastic shopping bags are going to be a thing of the past in another area of the bay area. when does this ban go into effect, paul. >> reporter: they gave out reusable bags like this to those coming in to go shopping. tomorrow day, earth day, plastic bags like this will be a thing of the past in many cities in san mateo county. you can look forward to less plastic, bags that is. >> see what i put in my car this morning. >> this is the first day that i remembered to bring bags. i was always afraid i was going to leave them in the car. >> reporter: these ladies are ahead of the game.

starting tomorrow, grocery stores are joining several other bay area cities by doing away with single use carry out plastic bags, replacing them with paper or reusable bags. >> it's good for the environment. we don't have the waste in the landfills and it's harmful to animals. >> they're messy. people throw them everywhere. i would like it to be cleaner for my grand kids as they grow up. >> reporter: most end up as litter or in landfills. the new law will not completely eliminate plastic bags because grocery stores may still give them out for produce. there were mixed feelings about the law because if you forget to bring a bag, the store must charge you. >> they are getting money from taxes. they charge you for everything in the world. >> if i'm forgetful enough to forget mine, i'm gladly going

sessions. santa barbara says that it would help schools and measures by making more classes available. but opponents say it would create a two-tier educational system where richer students could could into more classes. it now moves to the assembly appropriations committee. >> a woman accused of kicking a toddler at the golden gate park will be in court tomorrow. she was arrested last month after she allegedly kicked the child in the chest and threatened other children and parents at the playground. the 1-year-old girl suffered bumps and bruises. she pleaded not guilty to five counts, including felony assault. >> it has been a violent two weeks in richmond with investigators investigates five homicides. we talk to a pastor who is trying to help the community

while dealing with tragedy in his own family. >> i pray for your protection on this area right now. >> reporter: over the years, richmond pastor raymond has had to bury a lot of friends from his own neighborhood. but recently the gun violence literally hit home. he is looking around and wondering. >> any one of these young men shot up my grandmother's house and shot my brother who wasn't the intended victim. it's a little saddening. >> reporter: just two sundays ago, the pastor's brother was hanging out on this driveway when a man walked up the street and started shooting. his brother survived with several gunshot wounds but the emotional wounds persist for the family. >> as a pastor, i hate to admit this, but i will, i probably need counseling myself right now because, you know, it

hurts. >> reporter: it's been a violent few days in richmond. a brother and sister were gunned down on mclaughlin. a man was shot last night on griffin drive. pastor landry says that he is praying hard for the children's generation, asking god to guide them on a better, more protective path. >> if we can get them loving one another, taking care of one another, i think we can, you know, minimize what's going on in richmond, oakland and other cities. >> reporter: richmond police are investigating all three shootings. so far no arrests. >> well, when we return, something that you don't see every day. it was supposed to be a day celebrating smoking pot. one went too far. that is a two-pound joint.

questions we're not going to get into right now because mark tamayo is going to talk about the weather. >> weather we do know the answer. more sunshine. temperatures have been warming up nicely. lots of 70s and mid to upper 80s today. we will show you the nice afternoon out there. san francisco out in the distance. not a patch of fog in sight. temperatures this afternoon, they warmed up. you probably felt it. look at san francisco, 76 degrees. oakland at 81. upper 80s inland out towards fairfield. the latest on the satellite radar, we have clear skies. a closer inspection as you can see, most of california is in the clear with the warm and dry weather pattern in place. as far as wind speeds, not much of an issue. you can see out of the northwest, it's 16 miles per hour. and it actually cooled off san francisco by mid to late afternoon. forecast deadlines for tonight, more clear skies. tomorrow, lots of sunshine.

temperatures still on the warm to hot side. then the extended dry weather pattern. but temperatures will be cooling off by wednesday, thursday and friday. tomorrow is earth day. we have a nice more cast for you as well with temperatures about the same as today. the warmest locations could be flirting with the 90-degree mark. here is where the fog is, down towards southern california. lots of sunshine. and with that area of high pressure building in, the sinking air, that is warming air. you probably felt it for today. no major changes for tomorrow. still a northerly breeze. as a result, clear skies. the beach is mid-60s to 70s. then the other temperature range through the other end of the temperature spectrum, upper 80s to 90 degrees. as far as the cloud and rainfall forecast model i was talking about the clear skies, fog developing tomorrow morning. 3:00, while you're in bed. and by the afternoon hours,
